EULA VERSION: 1.0 Portfolio Manager: Smart Capabilities Terms of Use INFINITYDEV, S.L. (NIF B-44974798) Effective: 2026-10-10 These Smart Capabilities Terms ("Terms") are Feature-Specific Terms under section 22 of the TrendSurfers Portfolio Manager End-User License Agreement ("EULA"). They apply only to the Smart Capabilities feature. They supplement the EULA and do not replace it: the EULA's platform-dependency terms (section 13), disclaimer of warranties (section 14), limitation of liability (section 15), indemnification (section 17) and governing law and jurisdiction (section 20) apply to Smart Capabilities. Capitalised terms not defined here have the meaning given in the EULA. "InfinityDev" means INFINITYDEV, S.L. 1. WHAT SMART CAPABILITIES DOES Smart Capabilities is an optional feature. It is off until You turn it on, and only You can turn it on, in the Software's Settings, after accepting these Terms. AI agents and other tools connected to the Software cannot turn it on. When it is on, the Software performs, on Your own computer and in Your own MetaTrader 5 installation, routine steps that You could also perform yourself by hand, including: (a) reading the MCP key shown in MetaTrader 5's Options window, or creating a new one there when none exists; (b) switching on MetaTrader 5's built-in MCP server in that window; (c) opening Expert Advisors in MetaTrader 5's Strategy Tester, or asking MetaTrader 5's built-in MCP server, to read their input parameters and default values; and (d) saving input lists and default parameter (.set) files built from what was read. Its only purpose is to save You time and to let the Software work together with Your own MetaTrader 5 installation. 2. HOW IT WORKS Smart Capabilities works only through MetaTrader 5's own windows, menus and dialogs, and through MetaTrader 5's built-in MCP server, in the same way a person using the terminal would. It does not: (a) reverse engineer, decompile, disassemble or modify MetaTrader 5, any Expert Advisor or any other program; (b) read or write the memory of MetaTrader 5 or of any other program; (c) decrypt any file or setting of MetaTrader 5 or of any Expert Advisor; (d) bypass, disable or work around any protection, licensing or access-control mechanism; or (e) use MetaTrader 5 in any way that the terms of MetaQuotes do not allow. 3. LOCAL ONLY Smart Capabilities runs entirely on Your computer, for interoperability between the Software and Your own MetaTrader 5 installation. The MCP key, input lists, default parameter files and any other results it produces ("Smart Capabilities Output") are stored only on that computer. InfinityDev does not receive, collect, store or process Smart Capabilities Output, and the Software does not send it to InfinityDev or to TrendSurfers. If You choose to pass Smart Capabilities Output to other tools, including AI agents You connect to the Software, You do so under Your own responsibility and subject to section 5. 4. YOUR OBLIGATIONS You must: (a) comply with the terms that apply to Your use of MetaTrader 5, including the MetaTrader 5 license terms and the rules of MetaQuotes and MQL5.com, and with the license terms of every Expert Advisor You use; (b) use Smart Capabilities only with MetaTrader 5 installations, accounts and Expert Advisors that You are entitled to use; and (c) keep Your MCP key confidential. 5. NO DISTRIBUTION Smart Capabilities Output is produced for Your own use on Your own computer. You must not distribute, sell, license, publish, upload, share or otherwise make available any Smart Capabilities Output, in whole or in part, to any third party, whether free of charge or for payment. This prohibition is strict and has no exceptions. 6. YOUR RESPONSIBILITY You are solely responsible for turning Smart Capabilities on, for how You use it and for Smart Capabilities Output. To the fullest extent permitted by applicable law, InfinityDev and TrendSurfers are not responsible for Your actions, for any breach by You of these Terms or of any third party's terms (including the terms of MetaQuotes and of Expert Advisor vendors), or for any consequence of such a breach. Section 17 of the EULA (indemnification) applies to any claim arising from Your use of Smart Capabilities or from Your breach of these Terms. 7. NO WARRANTY; PLATFORM CHANGES Smart Capabilities is provided "as is" under section 14 of the EULA. Its results may be incomplete or inaccurate; check them before You rely on them. Smart Capabilities depends on how MetaTrader 5 looks and works. A MetaTrader 5 update or any change by MetaQuotes may change it or stop it working at any time (EULA section 13). This is not a defect and does not entitle You to a refund or any other remedy. 8. TURNING IT OFF You may turn Smart Capabilities off at any time in the Software's Settings. From then on the Software starts no new automated step. Smart Capabilities Output already on Your computer stays there; You may keep it or delete it, and section 5 continues to apply to it. 9. TRADEMARKS MetaTrader, MetaQuotes and MQL5 are trademarks of MetaQuotes Ltd. InfinityDev and TrendSurfers are not affiliated with, endorsed by or sponsored by MetaQuotes Ltd. (EULA section 12). 10. CHANGES TO THESE TERMS InfinityDev may change these Terms. Each version has its own version number and effective date. When a new version applies, Smart Capabilities stays off until You accept that version. 11. ACCEPTANCE By selecting "Accept and turn on", You confirm that You have read and accept these Terms. If You do not accept them, Smart Capabilities stays off and the rest of the Software is unaffected.
